1. Agreement to Terms

By accessing or using the Digital Den website (digitalden.com.au) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

2. Our Services

Digital Den provides the following services to businesses and individuals:

  • Tech support (remote and on-site)
  • Web design and development
  • Digital marketing (SEO, Google Ads, social media)
  • AI consulting

The scope, pricing, and timeline for each service will be agreed upon before work begins. All quotes are valid for 30 days unless otherwise stated.

3. Pricing and Payment

All prices are quoted in Australian Dollars (AUD) and are inclusive of GST where applicable. Payment terms will be outlined in your quote or service agreement. We accept bank transfer and other payment methods as agreed.

For ongoing services, invoices are issued monthly and are due within 14 days of the invoice date unless otherwise agreed.

4. Intellectual Property

Upon full payment, you will own the final deliverables (such as website files, designs, and content) created specifically for your project. We retain the right to use completed work in our portfolio and for promotional purposes unless you request otherwise in writing.

Any third-party tools, software, fonts, or stock imagery used in your project remain subject to their respective licences.

5. Client Responsibilities

To ensure timely delivery of our services, you agree to:

  • Provide all requested content, images, and information in a timely manner
  • Review and provide feedback on deliverables within agreed timeframes
  • Ensure any content you provide does not infringe on third-party intellectual property rights
  • Maintain backups of your own data before any tech support session

6. Limitation of Liability

Digital Den provides services on a best-effort basis. While we take every reasonable precaution, we are not liable for:

  • Data loss during tech support sessions (we recommend backing up your data beforehand)
  • Third-party service outages or failures (hosting providers, domain registrars, etc.)
  • Search engine ranking results (SEO is influenced by many factors outside our control)
  • Revenue or business losses resulting from website downtime or marketing campaigns

Our total liability for any claim arising from our services is limited to the amount you paid for the specific service in question.

7. Cancellation and Refunds

You may cancel a service engagement at any time by notifying us in writing. If work has already commenced:

  • You will be invoiced for work completed up to the point of cancellation
  • Any unused portion of a prepaid service may be refunded at our discretion
  • Custom design or development work already delivered is non-refundable

For remote tech support: if we cannot resolve your issue, you do not pay.

8. Warranties and Guarantees

We stand behind our work. If you experience issues with a recently completed service, contact us within 30 days and we will make reasonable efforts to resolve it at no extra cost. This does not cover issues caused by third-party changes, hosting problems, or modifications made by others after delivery.

9. Confidentiality

We treat all client information as confidential. We will not disclose your business information, login credentials, or project details to any third party without your express consent, except where required by law.

10. Website Use

When using our website, you agree not to:

  • Use the site for any unlawful purpose
  • Attempt to gain unauthorised access to our systems
  • Copy, reproduce, or redistribute our content without permission
  • Submit false or misleading information through our contact forms

11. Governing Law

These terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.

12. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
